In a case where the departmental fire and rescue service had given a favourable opinion on the grant of planning permission, subject to the installation of equipment designed to offset the fire risks to which the proposed building would be exposed, the Conseil d’État holds that the provisions of Article R. 111-2 of the Town Planning Code required the mayor to grant the permission sought, subject to special conditions.
